1. Agreement to Terms
By accessing and using the services of Atooba ("we," "our," or "us"), you ("client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. By using our services you represent that you are at least 18 years of age.
2. Services Offered
Atooba provides the following services:
- Website Design & Development: Static and dynamic website creation
- Web Hosting: Website hosting services with SSL, CDN, and backups
- Domain Registration: Domain name registration and management
- Digital Visiting Cards: Digital business card creation
- Email Hosting: Professional email hosting (Free and Paid options)
- SEO Services: Search engine optimization and Google Business Profile setup
- Technical Support: Ongoing technical assistance during office hours
3. Service Plans & Pricing
3.1 Website Design & Hosting Plans
- Starter Plan (Static 1 Page): Rs 3,600/year (Renewal: Rs 3,700/year)
- Business Plan (Static 5 Pages): Rs 6,500/year (Renewal: Rs 7,000/year)
- Premium Plan (Dynamic 5 Pages + Blog): Rs 8,000/year (Renewal: Rs 8,500/year)
3.2 Additional Services
- Extra Pages: Rs 300 per page (Renewal: Rs 500 per 5 pages)
- Blog Pages (Premium Plan): Rs 20 per page (Renewal: Rs 100 per 20 blogs)
- Digital Visiting Card: Rs 350/year (Renewal: Rs 250/year)
- Email Hosting (Free - Zoho): Rs 400 setup (Renewal: Rs 400-500/year)
- Email Hosting (Paid - Hostinger): Rs 1,500-1,800/year
- Advanced SEO: Rs 6,000 for 6 months
3.3 What's Included in All Plans

4. Payment Terms
4.1 Payment Schedule
- Full payment is required before project commencement
- Annual renewal payments are due before the service expiry date
- Failure to renew may result in service suspension
4.2 Payment Methods
We accept payments via:
- Bank transfer / NEFT / RTGS / UPI
- Online payment gateway
- Cash (by appointment in Navi Mumbai)
4.3 Refund Policy
- Refunds available only if service has not been initiated
- Once website development begins, payments are non-refundable
- Domain registration fees are non-refundable
- No refunds for partial year services
5. Service Delivery
5.1 Delivery Timelines
- Starter Plan: 10 working days
- Business Plan: 15 working days
- Premium Plan: 15 working days
Timelines are indicative and may vary based on client's content availability and response time.
5.2 Client Responsibilities
Clients must provide:
- Content (text, images, logos) in digital format
- Business information and details
- Timely feedback and approvals
- Valid contact information
- Domain registration details (if registering in client's name)
6. Domain Registration
- Domains are registered using client's email and contact information
- Client owns the domain, but we manage it during the service period
- Domain renewal is separate and handled through the registrar
- We are not responsible for domain expiry if client fails to renew
- Domain transfer requests require written notice
7. Content Ownership & Usage
7.1 Client Content
- Client retains ownership of all content provided (text, images, logos)
- Client grants us license to use content for website creation
- Client is responsible for ensuring content doesn't violate copyrights
7.2 Website Design
- Final website design ownership transfers to client upon full payment
- We retain the right to showcase the website in our portfolio
- Source code and custom developments are client's property
8. Edits & Modifications
8.1 Included Edits
- Starter Plan: One small quarterly edit
- Business Plan: One small monthly edit
- Premium Plan: One small monthly edit + blog posting capability
8.2 Additional Edits
- Major changes not covered in plan will be quoted separately
- Redesign or structural changes are not included in edits
- Emergency edits may incur additional charges
9. Technical Support
- Office hours: Monday to Friday, 10:00 AM - 5:00 PM
- Support hours: Monday to Saturday, 10:00 AM - 6:00 PM via phone, email, and WhatsApp
- Response time: Within 24 hours on business days
- Emergency support may be available on request
10. Service Limitations
10.1 We Are Not Responsible For:
- Third-party service disruptions (domain registrars, hosting providers)
- Internet connectivity issues
- Browser compatibility issues beyond our control
- Content accuracy (client is responsible for their content)
- Search engine rankings (SEO results vary and are not guaranteed)
- Email deliverability issues caused by recipient spam filters
10.2 Service Uptime
- We aim for 99.9% uptime but cannot guarantee it
- Scheduled maintenance will be communicated in advance
- No compensation for downtime caused by third-party providers
11. Acceptable Use Policy
Clients agree NOT to use our services for:
- Illegal activities or content
- Adult content, gambling, or prohibited services
- Spam or malicious activities
- Copyright infringement
- Phishing or fraud
- Excessive resource usage that affects other clients
Violation may result in immediate service termination without refund.
12. Service Termination
12.1 By Client
- Client may request service termination with 30 days written notice
- No refunds for remaining service period
- We will provide necessary files and access for migration
12.2 By Atooba
We may terminate services if:
- Client violates terms of service
- Payment is not received after 15 days of due date
- Client uses service for prohibited activities
- Client becomes abusive or uncooperative
13. Renewal & Cancellation
- Services renew annually unless cancelled
- Renewal reminders sent 30 days before expiry
- Late renewal may incur reactivation charges
- Non-renewal results in service suspension after grace period (7 days)
- Data may be deleted after 30 days of service suspension
14. Data Backup & Security
- We perform monthly backups as part of our service
- Backups are stored for disaster recovery purposes
- Client is responsible for maintaining their own content backup
- We implement security measures but cannot guarantee 100% security
- Client should use strong passwords and keep them confidential
15. Liability & Warranty
15.1 Limitation of Liability
Our liability is limited to the amount paid by the client for the specific service in question. We are not liable for any indirect, incidental, or consequential damages including but not limited to loss of business, data, or profits.
15.2 Warranty Disclaimer
Services are provided "as is" without warranties of any kind. We do not warrant that services will be uninterrupted or error-free, though we make reasonable efforts to ensure quality service.
16. Referral Program
- Referral discounts are offered at our discretion
- Referral must be verified before discount is applied
- Both referrer and referred client may receive benefits
- Discount percentages vary and are subject to change
- Cannot be combined with other promotional offers
17. Modifications to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated via email. Continued use of services after changes constitutes acceptance of new terms.
18. Governing Law
These terms are governed by the laws of India and the State of Maharashtra. The courts at Navi Mumbai, Maharashtra, India shall have exclusive jurisdiction over any disputes.
19. Dispute Resolution
In case of disputes, we encourage amicable resolution through discussion. If unresolved, disputes may be taken to mediation before legal proceedings.
20. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our control, including natural disasters, government actions, pandemics, internet disruptions, or third-party service failures.
21. Entire Agreement
These Terms & Conditions, along with our Privacy Policy, constitute the entire agreement between Atooba and the client. Any verbal agreements must be documented in writing to be valid.

23. Acceptance of Terms
By making a payment or signing our service agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Note: These terms are designed to protect both the client and Atooba. We value transparency and fairness in all our business relationships. If you have any questions about these terms, please don't hesitate to contact us before using our services.
24. Google Ads and Marketing
Atooba may run Google Ads campaigns for business promotion. Ad performance may be measured using Google-provided analytics and conversion tracking tools. By using our website, you acknowledge that ad-related cookies and tracking technologies may be used as described in our Privacy Policy.
We cannot guarantee specific conversion outcomes from these ads; clicks are generated by genuine user interest.
